DMCA Policy

I respect the intellectual property of others and expect the same for my own. This page explains how to tell me if you believe something on carlchapmanrealtor.com infringes your copyright, and what I’ll do about it. It follows the Digital Millennium Copyright Act (17 U.S.C. § 512).

1. What’s on this site

Content on this site comes from three sources: my own writing, photographs, and design; MLS listing content owned by ARMLS and the listing brokerages and displayed under an IDX agreement; and material provided by the companies that run parts of the site, such as iHomefinder and Homebot. This site does not host user-posted content. The Property Organizer login is an account for saving searches and favorites; it does not allow anyone to publish anything on the site.

2. Listing photographs and descriptions

Listing photographs and descriptions are supplied by the listing brokerage through ARMLS. If you believe a listing on this site uses your work without permission, you can send me a notice under section 3 and I’ll act on it, but the fastest fix is usually with the listing brokerage named on the listing or with ARMLS, because the content originates there and is displayed on many sites at once.

3. How to send a copyright notice

Send notices to the person responsible for copyright notices on this site:

For me to act on it, your notice must include:

  • your physical or electronic signature, or that of a person authorized to act for you;
  • identification of the copyrighted work you believe has been infringed;
  • the URL or other location on this site of the material you want removed, with enough detail for me to find it;
  • your name, mailing address, telephone number, and email address;
  • a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and
  • a statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for the owner.

4. What I’ll do

I’ll review a complete notice promptly, remove or disable access to the material if the claim appears valid, and let you know what I did. For listing content I’ll also pass the notice to the listing brokerage or ARMLS as appropriate. Incomplete notices may be returned for the missing information.

5. Counter-notices

Because this site hosts no user-posted content, counter-notices rarely apply. If I remove material that a vendor or listing brokerage supplied and they believe the removal was mistaken, I’ll refer the matter to them and restore the material only as the DMCA’s counter-notice process allows.

6. Misrepresentation

Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages. Please make sure your notice is accurate before you send it.

7. Changes

I may update this policy; the dates at the top will change when I do.
